Terms & Conditions

Welcome to gillwallerarts.co.uk. These terms explain what happens when you purchase an original artwork or fine art print, or commission a bespoke pet portrait from me. If anything below isn't clear, get in touch and I'll happily explain.

 

Please read them before placing an order. Nothing in these terms affects your statutory consumer rights.

Copyright & Intellectual Property

Artist rights: Everything on this website — artwork, images, text, design, logos and graphics — belongs to Gill Waller and is protected by copyright. I retain full copyright over all artwork I produce, including mock-ups, concept sketches and prints. This means I'm free to create prints, calendars or other printed items using an image of the artwork, and to display commissioned pieces in my website gallery and on social media, unless we've agreed otherwise in writing.

 

Artwork and images may not be copied, reproduced, or used without my written permission, and may not be used for commercial purposes without a licensing agreement.

 

You're welcome to share a link or image for personal, non-commercial reasons (for example, on your own social media), as long as the work isn't altered and I'm credited as the artist.

 

If you buy an original artwork: you own the physical piece, but not the copyright. You can't reproduce, print, or sell copies of the image without my permission.

 

 

Shop Policies & Sales

Colours & representation: I do my best to show artwork as accurately as possible, but colours may look slightly different depending on your screen and lighting — I can't guarantee your monitor will display them exactly true to life.

 

Pricing & payment: All prices are in GBP and may change without notice. Prints and original artwork can be ordered and paid for directly through the website shop. For signed editions and commissions, I accept bank transfer from UK customers.

 

 

Commissions

The process: Before I begin painting, I'll share a mock-up or concept sketch so we can agree on composition, pose and overall direction together.

 

Deposit: Once you're happy with the proposed design, a non-refundable deposit of 40% of the total price is required to secure your booking. No work will begin until the deposit has cleared.

Once work has started on the painting I'm not able to make major changes, reworks, or changes of direction - only small tweaks at my discretion. Approving the mock-up means you're happy for the final piece to go ahead on that basis.

Final balance: The remaining balance is due on completion of the artwork, before it is shipped. If a completed commission is rejected, or the final balance isn't paid within a reasonable time of completion, I reserve the right to sell or otherwise use the artwork as I see fit. This doesn't happen lightly, and I'll always try to resolve things with you directly first.

All prices are agreed in advance. Any requests outside the original brief may incur extra charges, which I'll always discuss with you first.

Processing time: I'll agree an estimated completion and delivery time with you at booking, and will do my best to accommodate specific dates (a birthday, for example). Because each piece is handmade, occasional delays can happen — if that looks likely, I'll keep you posted.

 

Your right to cancel: Because commissions are made specifically for you, they're exempt from the standard 14-day cooling-off period that applies to most online purchases. However, you may cancel your commission at any time before paying your deposit. If you cancel after the deposit has been paid, any refund will take account of work already completed, materials purchased and other reasonable losses caused by the cancellation. 

 

 

Returns & Refunds

If your order arrives damaged, please get in touch as soon as possible, ideally within 48 hours, and include photos so I can sort it out quickly. This does not affect your statutory rights..

 

Prints: If a print arrives damaged or faulty, I'll arrange a replacement or refund. If you change your mind, you must let me know within 14 days of receiving it and return it within a further 14 days. Return postage for a change-of-mind return is your responsibility. Personalised or genuinely bespoke prints are excluded from this right unless they are faulty, damaged or not as described

 

CommissionsIf you cancel after paying the deposit, I may retain an amount to cover time already spent, materials used or purchased, and any work I have reasonably turned away. Any remaining balance will be refunded.

Because commissioned artwork is made specifically for you, I’m unable to offer returns or refunds for a change of mind once the work is complete. This does not affect your rights if the artwork arrives damaged, is faulty.

 

Originals & existing pieces: If you buy a ready-made original painting and change your mind, please tell me within 14 days of receiving it and return it within a further 14 days. The artwork must be carefully packaged in its original packaging and in the condition in which it was received. I may make a deduction from the refund if its value has been reduced by unnecessary handling or inadequate packaging.

 

Return postage is your responsibility, and I'd strongly recommend using a tracked and insured service for the full value of the piece. I can't offer a refund if the artwork is lost or damaged on its way back to me, so please make sure it's properly protected and insured before it leaves your hands. Once I've received it back in its original condition, I'll process your refund within 14 days.

 

 

Shipping & Delivery

All orders are shipped securely with tracking to the address you provide. If you're sending a piece as a gift, just let me know the recipient's address at checkout.

 

UK delivery: Free standard tracked delivery on all UK orders.

 

International delivery: I'm currently only able to ship overseas on a case-by-case basis — get in touch and I'll quote you for postage based on size and destination. International buyers are responsible for any customs fees or import taxes charged by their own country; these aren't included in the item price and I have no control over them.
